Response to DMCA Notices

Upon receiving a valid DMCA takedown notice that complies with the requirements above, Barrett Henry will act expeditiously to remove or disable access to the allegedly infringing material. We take all claims of copyright infringement seriously and will investigate each notice thoroughly.

Counter-Notification

If you believe that material you posted on nowtb.com was removed or disabled by mistake or misidentification, you may file a counter-notification. Your counter-notification must include:

  1. Identification of the material that was removed or disabled and the location where it appeared before removal.
  2. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  3. Your name, address, telephone number, and email address.
  4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Middle District of Florida if you are outside the United States) and that you will accept service of process from the person who provided the original DMCA notice.

Repeat Infringers

In accordance with the DMCA, we will terminate, in appropriate circumstances, users or account holders who are deemed to be repeat infringers.

Sharing of Contact Information

Please be aware that when you file a DMCA notice, your contact information, including your name, address, and email, may be shared with the party whose content is being reported. This is required under the DMCA to allow the alleged infringer the opportunity to file a counter-notification.

Electronic Signatures

Electronic signatures are acceptable for both DMCA takedown notices and counter-notifications. A typed full legal name at the end of your notice or counter-notification will be treated as a valid electronic signature for purposes of these proceedings.
