The three communities near Apollo Beach and Ruskin I can verify as age restricted from official association or builder sources are Southshore Falls in Apollo Beach, Sun City Center, and Valencia del Sol in Wimauma. Plenty of other south Hillsborough communities are marketed as "active adult," which carries no age restriction at all. That difference matters legally and at resale, so this guide lists only what each association says in writing.
I get asked for "the 55+ list" constantly, and most lists online are copied from aggregator sites where some communities are not actually age restricted. Below is the verified version, plus how to check any community yourself.
First, what does 55+ actually mean legally?
Age-restricted housing is lawful because of a carve-out. The Fair Housing Act generally bars discrimination based on familial status. The Housing for Older Persons Act, which amended 42 U.S.C. 3607(b), creates an exemption letting a community restrict occupancy by age. For the 55 or older exemption, a community generally must meet three conditions under 24 C.F.R. 100.305:
- At least 80 percent of occupied units must have at least one occupant who is 55 or older.
- The community must publish and adhere to policies demonstrating intent to operate as housing for persons 55 or older.
- It must comply with HUD verification rules, meaning it actually surveys and documents resident ages.
Florida adds a registration requirement for age-restricted communities under Fla. Stat. 760.29(4).
What that means for a buyer:
- The 80 percent rule leaves room. Up to 20 percent of units can be occupied with nobody 55 or older, which is why you see younger residents in a legitimate 55+ community.
- Usually only one occupant must qualify. Sun City Center requires at least one occupant of each dwelling unit be 55 or older, so a younger spouse is typically fine.
- Separate limits apply to minors. Sun City Center states no one under eighteen may live in a unit more than thirty days a year. Caps vary, so read the declaration.
- Your resale buyer pool is smaller. That is the honest tradeoff.
Age restricted vs "active adult," which are not the same
This is the most common mistake I see, and it costs people money.

If an adult-oriented setting is the reason you are buying, an all-ages community marketed as "active adult" gives you no protection. The declaration is the only thing that binds anyone.
The verified age-restricted communities
Southshore Falls, Apollo Beach
A Del Webb community in Apollo Beach, Hillsborough County. The community association's own site describes it as "A Del Webb 55+ Active Adult Community" and states the community contains 866 single and attached homes.
What you are buying: attached villas and detached single-family homes built roughly 2004 to 2016 by Del Webb and Centex. Gated, with clubhouse, pools, fitness and court sports. Construction finished years ago, so everything is resale at a consistent age, which makes comparables straightforward.
Practical note: homes from that era have roofs, HVAC and water heaters either recently replaced or due. That is the pricing variable between two identical floor plans. Get the age of all four systems before you offer, and read what fails a Florida 4-point inspection.
Sun City Center
The original and largest, an unincorporated Hillsborough County community where the Community Association operates the shared buildings and recreation in place of a municipal government.
The Association states that at least one occupant of each dwelling unit must be fifty-five or older, and no one under eighteen may live in a unit more than thirty days each year. It describes itself as a qualified age-restricted community meeting the federal statutes required for that status.
What you are buying: enormous variety. Development started in the 1960s, so you will find everything from modest 1970s villas to newer construction across a wide price range. Residents in the retirement portion are Association members.
Important: Sun City Center is not one HOA. Many separate neighborhood and condo associations sit inside it, each with its own documents and fees, layered on top of the Community Association. Two houses three streets apart can carry very different monthly obligations.
Valencia del Sol, Wimauma
A GL Homes community in Wimauma, about 20 minutes east of Ruskin. The Valencia del Sol Homeowners Association describes it as "a gorgeous 55+ gated community located in Wimauma, Florida."
What you are buying: single-family homes and villas from the late 2010s into the mid 2020s, the newest of the three, with a large clubhouse and resort-style amenities. Roofs and mechanicals are young, so you are buying finish level and lot position rather than deferred maintenance.
What about Kings Point?
Kings Point sits within Sun City Center and is widely described as 55+. I am not asserting a blanket age rule for it, for an honest reason: Kings Point is roughly a hundred separate condominium associations, each with its own recorded declaration. There is no single governing document I could verify as authoritative for all of it.
So the rule that binds you is in your specific association's declaration. Read its occupancy section. In any large community built in phases, verify at the association level, not the community level.
New construction vs nearly new resale

My take: nearly new resale usually wins here. The previous owner paid for the upgrades, the landscaping is in, and you can see the real tax bill instead of estimating it.
Villa or single family?
A villa is attached, usually sharing one or two walls, smaller, with exterior maintenance often handled by the association. A single-family home is detached with more yard and more upkeep on you.
The decision is less about size than about what the association maintains. In many 55+ communities the villa fee covers roof, exterior paint and lawn while the single-family fee does not. A villa fee that looks high may be cheaper once you price a roof reserve and lawn service yourself. Compare what the fee covers item by item, not the monthly number.
HOA and CDD costs, and how they differ
HOA or condo fees go to the association for amenities, common area maintenance, insurance on common elements, management and reserves.
CDD assessments come from a Community Development District, a special-purpose government that issued bonds for infrastructure like roads, water, sewer and stormwater. The CDD appears on your property tax bill, not your HOA statement, and has two parts: debt service that retires the bonds over a fixed term, and operations and maintenance that continues indefinitely.
Why it matters: the debt service portion can often be prepaid, and whether the prior owner did changes your cost materially. Pull the actual tax bill for the parcel from the Hillsborough County Tax Collector instead of trusting a listing estimate. In Sun City Center you may also hit a recreation or community association fee on top of a neighborhood fee. Get all of them in writing.
From my desk
I worked with a buyer who had narrowed her search to two homes in south Hillsborough that looked nearly identical on paper. Same bedroom count, similar square footage, about $12,000 apart, both marketed with language suggesting an adult community.
One was in a recorded age-restricted community. The other was an all-ages subdivision whose marketing leaned on amenities and a quiet setting. Nothing improper about it, but it had no age restriction, and she had assumed it did. We pulled both declarations. Twenty minutes, and it changed her decision completely, because community character was the whole reason she was buying.
We also caught CDD assessments differing by several hundred dollars a year, because one owner had paid down the debt service and the other had not. Invisible in both listings. Visible on the tax bill in two minutes.
My take: read the declaration and pull the tax bill. Those two documents answer most of what matters, and almost nobody reads either before writing an offer.
How to verify any community yourself
- Get the recorded declaration for the specific association, not a summary, and read the occupancy section.
- Check the association's published policy. HOPA requires it, so a legitimate 55+ community says so in writing.
- Ask whether it performs age verification surveys. No documentation means the exemption is not being maintained properly.
- Pull the parcel's tax bill to see the real CDD assessment.
- Ask for the budget, reserve study and any pending special assessment.
